This website contains information regarding a proposed class action settlement that has been preliminarily approved by the Court in Nishimura v. Gentry Homes, Ltd., Case No. 11-1-1522-07-RAN.
UPDATE AS OF 1/29/2021
- The Court overseeing the Gentry Hurricane Straps Settlement Repair Program issued an order extending certain Settlement Repair Program deadlines and setting a new cutoff date for participation;
- To sign up for the Settlement Repair Program, please immediately visit https://sagebilt.com or call SageBilt at 808-312-6951;
- Class Members must sign up by February 23, 2021 to schedule their repairs in the Settlement Repair Program;
- Any Class Members who do not sign up by February 23, 2021 to schedule their repairs will not have their qualifying homes repaired in the Gentry Hurricane Straps Settlement Repair Program, waiving those settlement benefits; and
- The Settlement Repair Program completion date is extended to March 25, 2021.
NATURE OF THE SETTLEMENT
This lawsuit is about the hurricane straps installed in certain Gentry homes. Hurricane straps are metal anchor straps, holdowns and connectors embedded in the concrete foundation and connected to the frames of the structures. The hurricane straps attach the frame of the home to its concrete foundation. Plaintiffs claim the hurricane straps are defective, prematurely corrode, and do not comply with codes.
Defendant denies all of Plaintiffs’ claims and allegations in the lawsuit.
THE SETTLEMENT CLASS
The Settlement includes all individuals and entities that own residential structures constructed with hurricane straps embedded in the foundations substantially completed on or after July 20, 2001 in the housing development known as Ewa by Gentry, located in the City and County of Honolulu, Island of Oahu, State of Hawai‘i, and all homeowners associations whose members consist of such individual and entity homeowners.
